Terms.
01Who we are
Tesseract VJ is made by MIXUDG LTD (“MIXUDG”, “we”, “us”), 42 Bluebell Close, Kingsnorth, Ashford, Kent, TN23 3NG, a company registered in England and Wales, number 17515725. You can reach us at hello@mixudg.com.
02These terms and Apple's licence
Your licence to use Tesseract VJ is Apple's Licensed Application End User License Agreement (the “Apple licence”). These terms add to it. If the two ever conflict, the Apple licence wins. By downloading or using the app, you agree to both. Apple is not responsible for the app or these terms, and we, not Apple, are responsible for the app and for dealing with any claims about it.
03What the app does
Tesseract VJ listens to the music playing and drives a show of live visuals in time with it, on your iPad or Mac and on a TV or projector connected to it. It needs an iPad, or a Mac with Apple silicon, running the system version shown on its App Store page. How well it follows the beat depends on the sound it hears: a line from a mixer works better than a microphone in a loud room.
04Flashing light — please read
Tesseract VJ strobes, flashes and cuts hard on the beat, in strong colour and hard contrast, on your device and on any screen it's connected to. It isn't suitable for people with photosensitive epilepsy.
For a small number of people, flashing light and pattern can bring on a seizure, including people who have never had one before. Stop using the app if you feel dizzy, disoriented or unwell, if your vision changes, or if your eyes or muscles start to twitch: cover one eye with your hand and look away from the screen. Don't close both eyes. If you have epilepsy, or have had a seizure before, talk to your doctor before using the app.
If you show the app to an audience, you are responsible, with the venue, for warning people that the show uses flashing light, and for following the venue's own rules.
05What you add, and what you record
Only add videos, photos, logos and text you have the right to use, and only share recordings you have the right to share, including the music in them. Playing recorded music in public usually needs licences from PPL and PRS for Music, which are normally the venue's to hold. Recording a show captures the music playing, and sharing that recording may need the permission of whoever owns the music.
What you add and what you record stay yours. We never see them: they stay on your device (see our Privacy notice).
06Track names
Track names come from Apple's Shazam service and can be wrong, especially for remixes and edits. Check before you rely on one. Shazam is a trademark of Apple Inc.
07What's ours
The app, its visuals, its design and its name belong to us. The title fonts that come with the app are open-licence fonts, used and supplied under the SIL Open Font License. Don't copy, sell, rent or reverse-engineer the app, except where the law allows you to.
08Using it fairly
Don't use the app to break the law, to infringe anyone's rights, or to show content that is unlawful or that you aren't allowed to show.
09Price, payment and refunds
The price is shown on the App Store and is paid to Apple, which handles payment and refunds. To ask for a refund, go to reportaproblem.apple.com. There are no in-app purchases or subscriptions.
10Your legal rights
If you are a consumer in the UK, the Consumer Rights Act 2015 says the app must be of satisfactory quality, fit for its purpose and as described. If it isn't, you're entitled to a repair or a replacement, or in some cases a refund or a price reduction. If the app damages your device or other digital content because we didn't use reasonable care and skill, we'll repair the damage or pay you compensation. Nothing in these terms affects these rights. Citizens Advice (citizensadvice.org.uk) can explain them.
11Our responsibility to you
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. Loss or damage is foreseeable if it was obvious it would happen, or if we both knew it might happen when you got the app.
We are not responsible for loss or damage that wasn't foreseeable, or that was caused by something outside our control. The app is for personal and performance use: if you use it in a business, we aren't responsible for loss of profit, business, revenue or opportunity, or for an event that was interrupted.
Nothing in these terms excludes or limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to exclude or limit.
12Updates, and if things stop
We may update the app to fix problems, improve it or keep it working with new versions of iPadOS and macOS. Some updates may be needed for the app to keep working. We'll keep Tesseract VJ working as described for as long as we offer it, but we can't promise it will run on every future device or system version.
You can stop using the app at any time by deleting it. If you seriously break these terms, your licence to use the app ends, as the Apple licence describes.
13Changes to these terms
We may change these terms, for example to reflect changes to the app or the law. We'll update the date at the top, and if a change matters to you, we'll mention it in the app's release notes on the App Store.
14The law, and getting in touch
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your own courts. If something goes wrong, please write to hello@mixudg.com first; we'll try to put it right.
How Tesseract VJ treats your information is in its Privacy notice.
